1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the services provided by HVAC Digital Hub ("we," "our," or "us"). By accessing or using our services, you agree to comply with these Terms. If you do not agree with these Terms, please do not use our services.
2. Service Description
HVAC Digital Hub specializes in providing digital marketing and lead generation services for HVAC (Heating, Ventilation, and Air Conditioning) companies.
3. Client Responsibilities
a. You agree to provide accurate and complete information to us.
b. You acknowledge that the success of our marketing and lead generation services may vary depending on various factors, including market conditions and your cooperation.
4. Payment and Fees
a. Payment terms will be outlined in the agreement between you and HVAC Digital Hub.
b. Fees are non-refundable, except as expressly provided in our agreements.
5. Confidentiality
a. Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the engagement.
6. Intellectual Property
a. HVAC Digital Hub retains ownership of all intellectual property associated with our services.
7. Termination
a. HVAC Digital Hub reserves the right to terminate services for any reason, including violation of these Terms.
8. Warranty and Lead Guarantee
a. HVAC Digital Hub offers a lead guarantee as part of our services. To qualify for this guarantee, you must adhere to our system and protocol and follow our recommendations. If, after billing, you do not receive a minimum of 10 leads within 15 days while following our system and protocol, we will not continue billing for our services until this lead guarantee is met. Please note that this guarantee does not include ad spend, which is billed separately as agreed upon in our service agreement.
9. Limitation of Liability
a. HVAC Digital Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
10. Indemnification
a. You agree to indemnify and hold HVAC Digital Hub harmless from any claims, losses, or liabilities arising from your use of our services.
11. Governing Law
a. These Terms are governed by and construed in accordance with the laws of British Columbia, Canada.
12. Changes to Terms
a. HVAC Digital Hub reserves the right to update these Terms at any time. Updated Terms will be posted on our website.
